Clean Air Act – Bill C-30

Proposed Amendment Status

CEPA preamble:

Canada is guided by the ultimate objective of the UNFCCC that is to prevent dangerous anthropogenic climate change.

Achieved

New definitions:

Drop new categories in CEPA for greenhouse gases and air pollutants

Achieved

Equivalency:

Remove proposed definition shifting definition of equivalency from regulation to effect.

Not achieved  

Equivalency of effects is still in the bill; however, the government proposed language to define “effects” in a way that has more environmental integrity (demonstrably and quantifiably equivalent to a regulation)

Air quality standards:

Require national standards to replace voluntary guidelines within six months of the Act coming into force with regulations no later than six months after.  Short, medium and long-term science-based targets.

Achieved

Significant areas:

Authority for Minister to designate significant areas.

Achieved

International air pollution:

Strengthen federal authority to regulate international air pollution.

Not part of amendments to C-30

Not achieved

GHG Emissions Reductions Targets:  Recognize Kyoto Target of minus 6%  below 1990 by 2012.  Set minus 80 %  below 1990 by 2050 as the long-term target and at least minus 25 % below 1990 by 2020.

  • Kyoto target: Achieved
  • 2020 target is “at least 20% below 1990 levels”-- in line with EU, but short of what CAN called for.
  • 2050 target is “at least 60%below 1990 levels” – in line with the UK’s 2050 target, but short of what CAN called for.

Industry targets:

Fixed cap set at Kyoto level in force for 2008.  Permit-trading system linked to Kyoto-compliant trading systems.  Allow for some auctioning of permits with money raised to be used to cut GHG emissions.

Achieved,
with the exception of auctioning. However, the system does include a minimum carbon fine of $30/tonne from 2011 onwards.

Budget policy:

Require Minister of Finance to table projected impacts of budget measures on GHGs along with budget.

Not part of amendments; not achieved

Emissions Reduction Agency:

Establish arms-length agency to facilitate and implement domestic GHG actions

Partially Achieved
through the Green Investment Bank of Canada.

Efficiency Act Preamble:

Add preamble to support setting targets for continuous, economy-wide improvements in energy efficiency

Achieved

EE Standards:

Require standards for all products responsible for significant and/or increasing energy consumption.  Review and adjust standards every three years to meet or exceed most stringent levels found in NA.

Achieved.

The initial standards shall be set within 4 years, with review every 3 years thereafter.

Vehicle emissions:

Regulate to meet or exceed North American best practice to take effect in 2010 or 2009 if auto sector fails to meet MoU requirements.

Partially Achieved.

Regulations to be set one year after the expiration of the MoU (no provision for earlier entry if the MoU fails), with standards to be benchmarked against leading jurisdictions after 2011, taking into account technical feasibility.

Coming into force:

90 days after Royal Assent

30 days after Royal Assent

Notice of Intent:

Harmonize targets and regulations for industry to the highest standard.
